If you do not agree, do not use the Services.Broker Role: Smart Jet is an air charter broker registered under U.S. DOT Part 295. Smart Jet does not own, manage, or operate aircraft. All flights are provided by licensed Part 135 operators, who retain full operational control of flights.Termination: Smart Jet may terminate or suspend your access to the Services at any time, for any reason, without liability.Modification: Smart Jet may update these Terms at any time. Updates are effective upon posting on our site/app. Continued use constitutes acceptance.2. Arbitration AgreementBy using the Services, you agree to resolve any dispute with Smart Jet through binding individual arbitration rather than court, except as provided below.Class Action Waiver: You waive the right to bring or join any class, collective, or mass action against Smart Jet.Exceptions: Small claims court cases and certain intellectual property disputes may proceed outside arbitration.Process: Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Unless you and Smart Jet agree otherwise, arbitration will occur in Sarasota County, Florida.3. The ServicesThe Services enable users to:Search for, request, and book private jet flights (including empty legs and full charters).View and compare aircraft and operator options.Manage itineraries, payments, and customer support requests.Important:Smart Jet is not a direct air carrier. We arrange flights with licensed third-party Part 135 operators.Operators, not Smart Jet, decide whether to accept a booking request.Once a booking is confirmed, cancellation/refund policies are set by the operator, not Smart Jet.4. Third-Party Services and ContentFlights are provided exclusively by third-party Part 135 operators.Ground transport, catering, and other add-on services may also be provided by independent third parties.Smart Jet does not guarantee or endorse the quality, safety, or suitability of third-party providers.5. Accessing the ServicesAccounts: To use most features, you must register an account. You must be at least 18 years old.Accuracy: You are responsible for providing accurate and lawful passenger information.Security: You are responsible for maintaining the confidentiality of your account credentials.6. User Conduct and RequirementsYou agree not to:Use the Services for unlawful purposes.Provide false, misleading, or incomplete information.Interfere with the operation of the Services or other users’ experience.Carry prohibited or dangerous items on flights.Passengers must comply with all FAA, TSA, and operator rules. Operators may refuse carriage for violations.7. PaymentSmart Jet facilitates payments between you and operators via third-party processors (e.g., Stripe).Prices are displayed before booking; they may change prior to confirmation.Payments are final unless otherwise permitted by operator policy.Fees for cancellations, cleaning, damages, or special services may apply.8. Disclaimers; Limitation of Liability; and IndemnityDisclaimers:Services are provided “AS IS” and “AS AVAILABLE.”Smart Jet does not guarantee availability of flights, aircraft type, amenities, or pricing.Smart Jet is not liable for delays, cancellations, force majeure, or operator actions.Limitations:
To the fullest extent permitted by law, Smart Jet shall not be liable for indirect, incidental, special, or consequential damages. Smart Jet’s total liability in any case is limited to amounts paid by you for the affected booking.Indemnity:
You agree to indemnify and hold harmless Smart Jet, its officers, employees, and affiliates from any claims arising out of your use of the Services or violation of these Terms.9.
